But Nokia's a year into a massivetransformation. It wants to own the mobile experience on the phone,not just the phone. It has made investments in everything frommusic to file-sharing to advertising. It's also purchased Symbian,the mobile operating system, which it intends to give away and makeopen source. Meanwhile, it's hard to not look at RIM's (       NSDQ: RIMM      ) Blackberry, Apple's iPhone, or even Google's Android as worthyefforts, given those companies' track-records in Internet andsoftware applications vs. Nokia's background in manufacturing. Inan attempt to clear up the matter, Forbes reported a number ofraces in which the iPhone's software appears to win. Research firmPerceptive Sciences asked 10 people to send e-mails from an iPhoneand an N95. On average, the users took two and a half minutes onthe iPhone and twice as long on the N95. Only half of the peoplecould even manage to send an e-mail on the N95. In a separate race,more than 80 percent of iPhone owners use its Web browser, comparedwith 60 percent of Nokia N95 users, according to M:Metrics, whichalso reported that the iPhone is used more often for socialnetworking, maps, applications and listening to music, whereas theN95 only beat out the iPhone when it came to watching video.      Clearly, there isn't a winner yet. Improvements can be made on allsides. An email shouldn't take two and a half minutes to send, andfrom most accounts, the iPhone still has to work on keeping aconnection while during a call. I had a month totest it out and out it through its paces.      Nokia/ WOM World offers trial devices to social media usersinterested in participating in their trial program.      The N95 8GB North American version is like the regular N95 8GB witha 5MP Carl Zeiss lens camera with auto-focus, video recording andmany other features.      My mobile carrier is ATetT so it was easy for me to drop in mySIM card and upgrade my current plan to unlimited data to test outthe applications I was really interested in, which were live mobilestreaming.         <description>        A federal judge in Phoenix on Wednesday permanently barred Arizonafrom using a state law to prosecute an online merchant who sellsshirts that list names of thousands of troops killed in Iraq.       U.S. District Judge Neil Wake didn't strike down as flatlyunconstitutional the 2007 law against selling products that usemilitary casualties' names without families' permission as flatlyunconstitutional.       But Wake's ruling said using the law to prosecute Dan Frazier underthe law's misdemeanor provisions would violate the Flagstaff onlinemerchant's First Amendment rights because Frazier's "Bush Lied -They Died" shirts are "core political speech" protected by theFirst Amendment.        "It is impossible to separate the political from the commercialaspects of that display," wrote Wake, an appointee of PresidentBush. "For example, the state argues that Frazier can sell hisshirts without displaying the soldiers' names. But Frazier'sproduct is his message, and his customers' message."       Arizona's law was enacted with little debate by the Legislature,with lawmakers and other supporters citing objections to Frazier's shirts during committee hearings. Louisiana, Oklahoma and Texashave enacted similar laws.       A spokeswoman for Arizona Attorney Terry Goddard said Goddard'soffice was reviewing the ruling, which came on a lawsuit filed onbehalf of Frazier, and did not immediately know whether it wouldappeal.       "I always knew the Constitution was on my side," Frazier said in astatement released by the American Civil Liberties Union.       Lee Phillips, a Flagstaff lawyer who represented Phillips on behalfof the ACLU, said the ruling means the law remains on the booksbecause the ruling applied only to Frazier.       "What the court is saying he is genuine in his political beliefs,"Phillips said.       It still could be possible to use the law to prosecute a person ina case without political circumstance or motivations, Phillipssaid.       Citing First Amendment concerns, Wake last September had issued apreliminary injunction against enforcement of the law againstFrazier while the lawsuit was pending.       The ACLU is also defending Frazier in a pending lawsuit filedagainst him in federal court in Tennessee by a couple whose soldierson was killed in Iraq. Like several other states, Arizona recently passed a       law       making it illegal to "knowingly use the name, portrait orpicture of a deceased soldier for the purpose of advertising forthe sale of any goods, wares or merchandise or for the solicitationof patronage for any business without having obtained prior consentto the use by the soldier or by the soldier's spouse, immediatefamily member, trustee if the soldier is a minor or legallydesignated representative." The law was aimed at aFlagstaff-based political activist, Dan Frazier, who produced       anti-war, "Bush Lied, They Died," shirts       featuring the names of soldiers killed in combat.       That law, always constitutionally dubious, was the subject of apreliminary injunction issued by U.S. District Judge Neil Wakebased on the finding that "Frazier had standing to challengethe State's law and that the controversy was ripe forreview" and that "Frazier had shown a strong likelihoodof success on the merits."       Given Judge Wake's earlier ruling, it's no surprise that he hasissued a permanent injunction, preventing the state of Arizona fromenforcing the law against Frazier and his enterprise.       In his ruling, Wake dismissed lawmakers' claims that Frazier'sspeech was unworthy of full protection since he's engaged in thecommercial activity of selling shirts. "We were tight during the early years of his career. I sold KidRock cassettes out of the trunk of my car. He bought the businesswhen I faced a difficult personal time in my life," Stanzler said.       He worked as a paid consultant to Kid Rock for several months, thenleft to pursue an English degree from Wayne State University. Heplans to go to law school and study entertainment and copyrightlaw. "I've lived the experience," he said.       Stanzler sued a former employee to register his own name on thetrademark graphic of a man holding a wrench in the "Made inDetroit" logo. The design was part of an inspiration and mission tocreate a positive image of the Motor City. He is constantly workingon new designs.       Today he competes with a variety of retailers and wholesalers. PureDetroit sells city-themed merchandise at its stores in the Guardianand Fisher buildings and in the Renaissance Center.
